Exstrata Acquisitions LLC / Xpress Exit is a real estate investment company operating in Georgia that acquires residential and commercial properties directly from owners. Our services include:

Evaluating residential and investment properties for potential acquisition
Providing no-obligation cash offers to property owners
Facilitating the sale of properties through direct purchase or assignment of contracts
Communicating with prospective sellers via phone, email, and SMS/text messaging

The Company is not a licensed real estate brokerage and does not represent buyers or sellers in a fiduciary capacity. We are investors purchasing property for our own account or on behalf of affiliated investors.

3. Age Requirement

You must be at least 18 years of age to use our Services, submit information through our website, or consent to receive SMS communications from Xpress Exit. By submitting any form or engaging with our Services, you represent and warrant that you are 18 years of age or older. If you are under 18, you are not permitted to use our Services or provide your information. We do not knowingly collect information from individuals under the age of 18.

4. Eligibility & Authority

SMS CONSENT DISCLOSURE: By submitting your phone number through any form on our website, you expressly and voluntarily consent in writing to receive SMS/text messages from Xpress Exit / Exstrata Acquisitions LLC about your real estate inquiry. This consent is NOT required to receive any service. Msg & data rates may apply. Message frequency varies. Reply STOP to opt out. Reply HELP for help.

5.1 Express Written Consent

Your voluntary submission of a mobile phone number via our website forms constitutes your express written consent under the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, to receive SMS and/or MMS messages from us. Opt-out requests will be honored promptly. Opting out does not affect any pending real estate transactions or other communications you have separately requested.

5.6 Message & Data Rate Disclosure

Standard message and data rates may apply to all SMS messages you send and receive. These rates are determined and charged by your mobile carrier and are entirely outside the control of Xpress Exit or Exstrata Acquisitions LLC. Please contact your mobile carrier for information about applicable rates under your plan.

5.7 Carrier Liability Disclaimer

CARRIER LIABILITY DISCLAIMER: Xpress Exit and Exstrata Acquisitions LLC are not liable for delayed or undelivered SMS messages. Delivery of SMS messages is subject to effective transmission from your mobile carrier network. Mobile carriers are not liable for delayed or undelivered messages. Message delivery is not guaranteed and may vary based on network availability, carrier policies, and device compatibility. Neither the Company nor any wireless carrier shall be liable for any delays or failures in the receipt of any SMS messages.

5.8 No Selling of Mobile Data

We do not sell, rent, share, or transfer your mobile phone number or SMS consent data to any third party for marketing or promotional purposes. Mobile opt-in information is used solely to communicate with you about your real estate inquiry as described in these Terms.

5.9 Future Automation

The Company may in the future deploy AI-powered voice and SMS automation tools. Should such tools be implemented, we will update this agreement and ensure all applicable consent and disclosure requirements are met prior to deployment.

6. User Representations & Obligations

By using our Services, you represent, warrant, and agree that:

All information you provide is truthful, accurate, and complete to the best of your knowledge
You are the legal owner of the property you are inquiring about, or are duly authorized to act on behalf of the legal owner
You will not use our Services for any unlawful purpose
You will not attempt to gain unauthorized access to our systems, data, or networks
You will promptly notify us of any change in your contact information, including your phone number

7. No Obligation to Purchase

Submission of your property information through our website does not create any obligation on the part of the Company to make an offer, negotiate, or purchase your property. Any offer made by the Company is subject to inspection, title review, and other due diligence, and may be modified or withdrawn prior to execution of a binding purchase and sale agreement.

Similarly, submission of your information does not obligate you to accept any offer or sell your property to the Company.

8. Intellectual Property

All content on the https://xpressexit.com website, including text, graphics, logos, images, and software, is the exclusive property of Exstrata Acquisitions LLC or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. EXSTRATA ACQUISITIONS LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EXSTRATA ACQUISITIONS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF OUR SERVICES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED $100.00.

11. Indemnification

You agree to indemnify, defend, and hold harmless Exstrata Acquisitions LLC, its officers, directors, employees, agents, and successors from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any applicable law; or (d) any misrepresentation made by you.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles. Any dispute shall be resolved exclusively in the state or federal courts located in Fulton County, Georgia.

Before initiating any legal proceedings, you agree to first contact us at info@xpressexit.com to attempt informal resolution. If we cannot resolve the dispute informally within 30 days, either party may proceed with formal legal action.
